When Is it Appropriate
to Request Special Legislation?
    This question is often asked and not often answered. According to the survey, economic development professionals listed the following instances that special legislation may be warranted: significant investment (79 percent), job creation (76 percent), higher job quality (62 percent), and job retention (59 percent). In addition, the economic development community is looking for high-profile companies to create public relations benefits for the community.
      Thirty-six percent of corporate sector respondents have requested special legislation for a specific project. The requests have been primarily based on significant investment and job creation (both 75 percent). The corporate sector should be aware that economic development agencies see higher job quality and job retention as issues that may drive legislation.

The Great
Clawback Divide
    Managing risk has become a key business issue over the past three years. The corporate sector is currently tackling risk through a variety of mechanisms, most notably documenting business processes so they can be managed and improved. The corporate sector sees the greatest incentive risk in clawbacks, followed by disclosure demands and deadlines for reporting and filing.
      But while 73 percent of the corporate sector determined that clawback language is getting stronger, only 48 percent of the economic development community agreed. Likewise, although 72 percent of the economic development community imposes strict clawback language into their incentive contracts, only 49 percent of the corporate sector agrees to it.
